Does the Indefinite Detention Bill Foretell Future?

The recent passage of the National Defense Authorization Act (Senate Bill 1867), otherwise known as the “Indefinite Detention Bill,” should scare the heck out of anyone who loves the U.S. Constitution and the Bill of Rights.  This bill effectively hands over control to the military to arrest, torture and even kill terrorists on American soil.  It also allows the military to hold suspected terrorists indefinitely without a trial or due process.  This applies to both non-citizens and citizens of the United States!  With this bill, you are not innocent until proven guilty.  You are guilty until proven innocent, and you may never get a trial to defend yourself.  There is surprisingly little written in the mainstream media about this Senate bill that passed 93 to 7 at the end of November.

Last week, Wired.com posted a compelling article on the “Indefinite Detention” debacle.  It said in part, “So despite the Sixth Amendment’s guarantee of a right to trial, the Senate bill would let the government lock up any citizen it swears is a terrorist, without the burden of proving its case to an independent judge, and for the lifespan of an amorphous war that conceivably will never end. And because the Senate is using the bill that authorizes funding for the military as its vehicle for this dramatic constitutional claim, it’s pretty likely to pass.

It would be one thing if the military was clamoring for the authority to become the nation’s jailer. But to the contrary: Defense Secretary Leon Panetta opposes the maneuver. So does CIA Director David Petraeus, who usually commands deference from senators in both parties. Pretty much every security official has lined up against the Senate detention provisions, from Director of National Intelligence James Clapper to FBI Director Robert Mueller, who worry that they’ll get in the way of FBI investigations of domestic terrorists. My question is who decides who is a terrorist, and who checks to make sure the charges are valid?

The Senate bill must now be reconciled with a House-passed version (H.R.1540).  If this bill gets through the House of Representatives in the form it is now, and is signed by the President, the military will answer to no one.  The only hope of short circuiting this bill is for the House to change it radically in the reconciliation process.  I think arch conservatives and arch liberals should unite and radically change this legislation to follow the Constitution instead of gutting it.  You think that can’t happen?  Senators Rand Paul and Al Franken are on the same page on this issue, and that represents both extremes of the political spectrum.  Every American, no matter the party, should be terrified by this legislation whether you are Democrat, Republican or Independent.

My other big concern is if 93 Senators from both parties voted for this unconstitutional legislation, what do these folks see coming?  What future scanario do they all see?  Billionaire investor George Soros is not looking at a rosy future from his vantage point.  He see’s global financial calamity coming.  He recently said, “The global financial system is in a “self-reinforcing process of disintegration. . . .The consequences could be quite disastrous.”  (Click here for more on Soros.)

        Wait I’m lost .. I know .. I should read a whole LOT more … but isn’t the House filled with the Republicans who WANT this? And would the President sign this? Isn’t this just more of what Bush and Cheney wanted or am I just lumping things into certain obvious baskets of bi-partisanship. I will definitely sign the petition but I am surprised to think the House would defeat this. People like Eric Cantor are as paranoid and profit minded and controlling as Cheney was.

          Really, I donot distinquish the difference between the two political parties. I think Obama is just an Republican in Democrat clothing. What goes on behind the walls in the house stays in the house and we will never know nothing til it is too late. Why do you think they allow illegals into our country? They could be planning on using them under the new military to imprison and guard us.(I know I sound paranoid) So much for winning the hearts and mind of the enemy. The Enemy is them who we elected.           I find that the more I read the more I realize just how much MORE there is to read. The fact that you are spending some time reading up on these things is superb. On the subject of bi-partisanship keep in mind that it is just a ruse. The myth of 2 different parties is simply used to divide the American people so that we aren’t united against the politicians. There is no real difference between the 2 parties. We have seen time and time again that the politicians on both “sides” make a big show of how they are supposedly dedicated to some kind of “principles” but in the end they vote for terrible legislation that continues to chip away at the constitutional rights of the people. It’s like the 2 parties have a few stooges playing a giant game of ping pong out in the public eye to keep the masses distracted while the rest of them (from BOTH parties) are hidden away in the back rooms cutting dirty deals. Once the ping pong game is over the masses will have forgotten about whatever the issue was and the few of us who realize that game was just a distraction will learn about what really happened from alternative news sources like this website.

    Greg, I heard about the Senators passing this bill, scary stuff and Circa 1935 Germany comes to mind. What is even more scary is the thought that our leaders would even propose much less vote for it in the first instance. That leads me to your question …”what do these folks know is coming?” I believe they all have been briefed that there is a high likely possibility of a financial collapse which would bring out pockets or even regions of instability, anarchy if you will. That way the police and or the military would not have to wait around parks for days on end before hauling off the protesters to camps or wherever. When the american people find out that they can be taken away by a declaration of some thought police they will have to stay in their homes and do what they are told or else maybe never been seen again. I do feel you are right in suggesting that they must know something we don’t because in theory no law is enacted for the sake of enactment, it must address some problem or attempt to progress, restrict, or promote something for the benefit of the country. What may be even scarier is that the one Senators who are up for election next year and who voted for this bill will probably be reelected. In the end though the American people will have to take the responsibility and suffer for their actions in maintaining such leaders in perpetuity. History may record that the American people were so fully engaged with their sports and electronics that they lost all interest in preserving their own freedoms which they took for granted believing their leaders had their best interest at heart and would never grab power from them.

        I congratulate you for beginning your search for the truth. One of the first steps you have to make is to realize that all the hoopla you hear on TV about Democrat vs. Republican and liberal vs. conservative is utter nonsense. They only claim to have these differences when they are in the spotlight. There is no real difference between the 2 parties. Neither party is going to step in to save the day! Note that (as someone posted above) the bill passed with 93 out of 100 votes! Therefore NEITHER party was truly against this bill! If you look at the 7 “no” votes that may give you a clue as to how many Senators there are that MIGHT be honest. (Don’t assume that all the “no” votes are good guys though.) I hope you saw my response to you above about the giant game of ping pong.

    It is not the passing of this bill that will make the USA a police state. The USA became a fascist police state about a decade ago. Things have been going downhill ever since. It is precisely because the USA is already a fascist police state that such laws are even considered. It is also why I stopped going there.

    You say that Obama promised to veto this legislation – but it is important to know why. You see, the initial proposal included language expressly precluding “the detention of citizens or lawful resident aliens of the United States on the basis of conduct taking place within the United States, except to the extent permitted by the Constitution of the United States.” The Administration wants that this language be removed from the bill. That is, Obama threatens to veto the bill unless this text is removed from it! It’s not your civil liberties that he is concerned about; just the opposite.

    It happens that many Generals and Admirals are members of the Council on Foreign Relations and worse still, The Pilgrims Society of the United States, which exists to re-take North America for the British Crown. The Pilgrims have always been the management of more visible organizations, as they are ID’d as “the first organization” (Review of Reviews, May 1902, pp 557-558). When the 17th Amendment was passed allowing for direct election of Senators, it gave the Money Power the pathway leading to this atrocity. This plan to return us to Crown feudalism can only be halted if enough people become aware of it. Overseas interests are the enemy and they are based in England not the Middle East.

    Why is there no outrage over this action taken by out elected representatives? Simple, We the People no longer care what happens to us. We already have a travesty to freedom called the Transportation Security Administration (TSA). We the People have already given away our freedom to move about our country, and the world, to this government controlled bureaucracy. “Show me your papers” will be next. Does this sound familiar?

    Why is no one calling for the impeachment, under the constitution, of the senators who voted for this? Why is there no outrage?     Once the U.S. military has the ability to DETAIN ANYONE for ANY REASON, they will. Who can stop them? They have at their disposal the most lethal weapons systems, on the planet, to use against We the People.

    I am outraged and I am calling for the impeachment of those senators, starting with McCain, who voted to steal our freedoms, again! These senators are traitors to the ideals of America! I also call upon our military leaders to deny this power to anyone that would use it against We the People!

    These are excellent questions Greg. I have not posted here in a while because I got tired of regurgitating the same message. Get gold and Silver, get food, guns and bullets. etc.

    If this vote does not wake people up to what is coming, then nothing is going to. As you point out here often, the rule of law is gone in America, from metals price suppression to MF Global to this monstrous legislation, unconstitutional lawlessness rules the day by the people we elect and the bankers that own them.

    This bill is the last stand for the neocon’s, is how I see it. The CIA ,FBI and some in the pentagon said it’s a bad idea. If the FBI and CIA has clean out the neocon’s in there departments, then that only leaves the pentagon. So I would think shifting power to the pentagon is the last chance for a neocon coup. Best write the White house and back a veto, if the bill is not change.

    The 5th amendment above seems to indicate the Military has the authority to hold terrorist but people seems to ignore the part where it says PUBLIC DANGER when arguing about the constitutionality of the act.

      deals with people in military service not civilians. The Military has the right to ajudicate members of the military or Militia during times of (declared) war or (times) of Public Danger. Thus why we have Military Tribunals.

    Greg, I wrote my Senator the day of the vote, Senator Dianne Feinstein wrote me back two days ago. That I am impressed with, considering her time commitments, she wrote me back very quickly. The other Senator from my state of California hardly ever writes back.

    I will let you read the letter below and comment on it if you care. I asked Senator Feinstein to vote “no” on the bill, but, she at least knew of my concern.

    The letter might also explain why so many Senators vote ‘yea” for it, since the bill “among other things, authorize funding for the U.S. Department of Defense”. Since it was all tied together it was hard to vote “na” in my opinion, because who wants to look soft on defense.

    But I felt my Senator tried her best to break the bill apart, read on….

    “Thank you for writing to express your concerns about the detention provisions in the “National Defense Authorization Act for Fiscal Year 2012.” I appreciate knowing your views and welcome the opportunity to respond.

    This year’s defense authorization bill would, among other things, authorize funding for the U.S. Department of Defense. As you know, section 1031 would authorize the U.S. government to detain suspected terrorists until the end of hostilities, and section 1032 would require that certain suspected terrorists connected to al-Qaeda be automatically detained in military custody when apprehended.

    Like you, I oppose these provisions. Section 1031 is problematic because it authorizes the indefinite detention of American citizens without due process. In this democracy, due process is a fundamental right, and it protects us from being locked up by the government without charge. For this reason, I offered an amendment to prohibit the indefinite detention of U.S. citizens without trial or charge. Unfortunately, on December 1, 2011, this amendment failed by a vote of 45-55.

    I was, however, able to reach a compromise with the authors of the defense bill to state that no existing law or authorities to detain suspected terrorists are changed by this section of the bill. While I would have preferred to have restricted the government’s ability to detain U.S. citizens without charge, this compromise at least ensures that the bill does not expand the government’s authority in this area.

    I also oppose section 1032 of the defense bill, which creates a presumption that individuals associated with al-Qaeda will be held in military custody, as opposed to being processed through the criminal justice system. I disagree with this approach, and believe that the President should be able to hold captured terrorists in the military or the criminal justice systems based on the individual facts and evidence of each case. Accordingly, I offered an amendment to clarify that under section 1032, the presumption of U.S. Armed Forces detention only exists for an individual captured abroad. Unfortunately, on December 1, 2011, this amendment also failed on a vote of 45-55.

    Once again, thank you for your letter. Please know that I am committed to ensuring that our nation has the appropriate tools to combat terrorism, and committed to upholding our fundamental constitutional rights. “

      She voted to gut the Constitution. Her answer may have made her feel better but I don’t feel any better. She should have voted “NO” and made the sponsors cut it out. hey knew it would be hard to vote down that’s why they combined them.         I come from the same lost state of California and have also written my Senators and Representatives for many of things they have voted for. The last one was the Obamacare legislation. California is a lost cause. The liberal mindset here IS fully represented by these two sell-outs Boxer and Feinstein. They are elected year after year as the state continues to go down in flames along with our country.

        I completely agree with Greg. Feinstein gutted the Constitution on this one and will continue to represent herself and her husband before anything else. Boxer is an old hag from New York who will vote for anything that will keep her in office.

        With that said, California is getting exactly what is has voted for…total destruction. Oh my… Jerry Brown too!

    I have often felt like I am living in a fictional book or movie over the past 3.5 years. Under the current law (or lawless in effect), any person can be name tagged as terrorist and lock away forever without a fair trial. There is no guarantee that the Military will not abuse this unlimited power. Nobody can control the Military any more. Anyone who oppose the Military can be arrested as terrorist and disappear forever. In theory, even the President, members of Congress and Supreme Court judges could be arrested if they are tagged as terrorists. I don’t know any other democratic and civilized country in the world has such irresponsible and abusive law.

    Consider the lack of intelligence of most legislators; both Houses surely passed the Bill without much thinking about the consequences. According to a 2007 report from National Gang Intelligence Center, gang activities in the armed force are increasing (http://militarytimes.com/static/projects/pages/ngic_gangs.pdf). “Some gang members may also enlist to receive weapons, combat, and convoy support training; to obtain access to weapons and explosives; or as an alternative to incarceration.” Not all members of U.S. Armed Force are heroes who protect our country. Why did the Congress want to give Indefinite Detention power to an unregulated Military with gang infiltration is beyond my imagination?

    The FBI once told me that anyone who engages in an illegal act — no matter how minor — with political motives is a terrorist. Specificly, I could be regarded as a terrorist for putting an anti-immigration sticker on a sign post not on my private property. It didn’t matter at all that there were posters for a band, for “we buy houses,” for a pizza place, etc. all on the same sign post.

    The very thought that this law could have been passed by the overwhelming majority of Senators that have sworn an oath to our constitution, is hard evidence of TREASON and those that voted for the legislation should be immediately arrested.

    The question in my mind is why are these people still in office and not in a federal prison cell awaiting trial?

    Do we even have a shred of our concept of a government under the law remaining? Who is going to demand the immediate resignation of all 93 of these traitors?     Very disturbing information from the Halls of Congress and still there are many who disbelieve at what stares them in their face. They can make all the laws they want in Congress, but who will enforce them? The question must be asked of Law Enforcement and our Military.     It is true the manner of warfare/law enforcement has changed to the point that it can be used effectively against civilians. We as a nation have built many prisons and those that fear the FEMA camps only have to look at our baseball and football stadiums as they hide in plain sight detention camps. Worked very well in El Salador under the management of the military.
    As technology advances, some embace it and others fear it. We can not escape it. It has enriched our lives but also enslaved us as it has freed up more time, the pace of life has quickened. We all leave digital foot prints to be tracked. The marvels of GPS, satellite communication, infra red, sound amplification, leaves us no place to hide.
    So where does it end? Does Congress have to pass every bill to see what is in it? Do we send hopeful Tea Partiers to correct the problems only to have them become the same as their predecessors? Do we allow Congress to pass bills just because they were past war heroes? We will! Just as we digest and rationalise the the unemployment, inflation, welfare and other manipulated stats that suites their plans for re-election.

    Attached is the latest version of the house bill (1540) am I confused or is all of this hoopla a little overblown. Read the section (1032 part b) that states: The requirement to detain a person in military custody under this section does not extend to citizens of the United States.
    What am I missing here……

    SEC. 1031. AFFIRMATION OF AUTHORITY OF THE ARMED FORCES OF THE UNITED STATES TO DETAIN COVERED PERSONS PURSUANT TO THE AUTHORIZATION FOR USE OF MILITARY FORCE.

    (a) In General- Congress affirms that the authority of the President to use all necessary and appropriate force pursuant to the Authorization for Use of Military Force (Public Law 107-40) includes the authority for the Armed Forces of the United States to detain covered persons (as defined in subsection (b)) pending disposition under the law of war.

    (b) Covered Persons- A covered person under this section is any person as follows:

    (1) A person who planned, authorized, committed, or aided the terrorist attacks that occurred on September 11, 2001, or harbored those responsible for those attacks.

    (2) A person who was a part of or substantially supported al-Qaeda, the Taliban, or associated forces that are engaged in hostilities against the United States or its coalition partners, including any person who has committed a belligerent act or has directly supported such hostilities in aid of such enemy forces.

    (c) Disposition Under Law of War- The disposition of a person under the law of war as described in subsection (a) may include the following:

    (1) Detention under the law of war without trial until the end of the hostilities authorized by the Authorization for Use of Military Force.

    (2) Trial under chapter 47A of title 10, United States Code (as amended by the Military Commissions Act of 2009 (title XVIII of Public Law 111-84)).

    (3) Transfer for trial by an alternative court or competent tribunal having lawful jurisdiction.

    (4) Transfer to the custody or control of the person’s country of origin, any other foreign country, or any other foreign entity.

    (d) Construction- Nothing in this section is intended to limit or expand the authority of the President or the scope of the Authorization for Use of Military Force.

    (e) Authorities- Nothing in this section shall be construed to affect existing law or authorities, relating to the detention of United States citizens, lawful resident aliens of the United States or any other persons who are captured or arrested in the United States.

    (f) Requirement for Briefings of Congress- The Secretary of Defense shall regularly brief Congress regarding the application of the authority described in this section, including the organizations, entities, and individuals considered to be `covered persons’ for purposes of subsection (b)(2).

    SEC. 1032. REQUIREMENT FOR MILITARY CUSTODY.

    (a) Custody Pending Disposition Under Law of War-

    (1) IN GENERAL- Except as provided in paragraph (4), the Armed Forces of the United States shall hold a person described in paragraph (2) who is captured in the course of hostilities authorized by the Authorization for Use of Military Force (Public Law 107-40) in military custody pending disposition under the law of war.

    (2) COVERED PERSONS- The requirement in paragraph (1) shall apply to any person whose detention is authorized under section 1031 who is determined–

    (A) to be a member of, or part of, al-Qaeda or an associated force that acts in coordination with or pursuant to the direction of al-Qaeda; and

    (B) to have participated in the course of planning or carrying out an attack or attempted attack against the United States or its coalition partners.

    (3) DISPOSITION UNDER LAW OF WAR- For purposes of this subsection, the disposition of a person under the law of war has the meaning given in section 1031(c), except that no transfer otherwise described in paragraph (4) of that section shall be made unless consistent with the requirements of section 1033.

    (4) WAIVER FOR NATIONAL SECURITY- The Secretary of Defense may, in consultation with the Secretary of State and the Director of National Intelligence, waive the requirement of paragraph (1) if the Secretary submits to Congress a certification in writing that such a waiver is in the national security interests of the United States.

    (b) Applicability to United States Citizens and Lawful Resident Aliens-

    (1) UNITED STATES CITIZENS- The requirement to detain a person in military custody under this section does not extend to citizens of the United States.

    (2) LAWFUL RESIDENT ALIENS- The requirement to detain a person in military custody under this section does not extend to a lawful resident alien of the United States on the basis of conduct taking place within the United States, except to the extent permitted by the Constitution of the United States.

    I just received a letter from my son who is in Marine basic training right now. He wrote in his last letter that his Senior Drill Instructor it telling them that our government is becoming corrupt and to remember that their allegiance is to the people not the government. This is a startling revelation to me that even our military is training for a potential civil unrest. Call it what you will but it looks like the military is choosing sides and doing a good job of it.

    I wonder if I’m missing something. I honestly want to understand. Does that not say the section does not apply to citizens of the United States?

      If you are taking about S 1867 you are missing the fact that the bill contradicts itself and also provides exemptions to these provisions. That is what many have reported, including Constitutional expert Judge Andrew Napolitano. I hope it gets fixed when the bill is reconciled between the House and Senate versions.

I saw how congress is going to fund eh National defense as it is am authorization bill for an appropriations for the military.       Part true JoJo, although many people have been hoodwinked and even though it could be argued that they are still to blame for allowing themselves to be hoodwinked one can’t ignore the great amount of effort those in power have put forth to hoodwink the masses.
      Let’s stay positive and enlighten people to the proper role of government, and that is to protect our right to be in charge of ourselves. It will do us well to focus on the free loving society, instead what currently has been allowed to be.
